Terms of Use & End User License Agreement (EULA)

These Terms of Use (the "Terms") form a binding legal agreement between you ("you" or the "User") and Mohit Bhalodiya, an individual operating under the trade name Mfinity Infotech ("we", "us", "our", the "Developer" or the "Licensor") regarding your use of the Mechanic Mate mobile application and any related websites, content and services (collectively, the "App").

By downloading, installing, accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant & Scope

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on a device that you own or control, solely for your personal or internal business use of managing your garage operations.

You may not: (a) copy, modify, reverse engineer, decompile or disassemble the App; (b) rent, lease, lend, sell, redistribute or sublicense the App; (c) remove any proprietary notices; or (d) use the App in any manner that violates these Terms or applicable law.

2. Account & Eligibility

You must be at least 18 years old and capable of entering into a binding contract under Indian law. To use most features you must register an account using a valid mobile number. You are responsible for keeping your account credentials confidential and for all activity under your account.

You agree to provide accurate, current and complete information during registration and to keep that information up to date.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful, fraudulent or harmful purpose
• Issue invoices or tax documents that are false, misleading or non-compliant with the Goods and Services Tax (GST) laws of India
• Upload or store any content that is illegal, defamatory, infringing, obscene or that violates the privacy or rights of any third party
• Interfere with the security or integrity of the App or the servers and networks connected to it
• Use the App to transmit viruses, worms, malware or any harmful code
• Attempt to access data or accounts that do not belong to you
• Use automated systems (bots, scrapers) to access or scrape the App without our written permission

4. Subscriptions & Payments

The App offers a free tier with optional paid subscription plans (the "Paid Plans"). Pricing, features and billing periods are displayed in the App at the time of purchase.

Billing

Paid Plan subscriptions are billed in advance on a recurring basis (monthly or annual, as selected). Payments are processed by third-party payment providers (such as Razorpay or, for in-app purchases on iOS, Apple). Charges are non-refundable except where required by law or expressly stated in these Terms.

Auto-renewal

Your subscription will renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings (or, for iOS in-app purchases, through your Apple ID settings).

Price changes

We may change subscription prices on a prospective basis. We will notify you at least 30 days before any price change takes effect for your account.

Taxes

All prices are exclusive of applicable GST and other taxes, which will be added at checkout where required.

5. Your Data & Privacy

Your privacy matters to us. Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

You are the owner of all garage, customer and invoice data that you input or upload to the App ("Customer Data"). We process this data on your behalf solely to provide the App. You are responsible for obtaining all required consents from your customers before storing their personal information in the App.

6. Intellectual Property

The App, including all software, source code, designs, text, graphics, logos and trademarks, is owned by Mfinity Infotech and its licensors and is protected by Indian and international copyright, trademark and other intellectual property laws.

"Mechanic Mate" and the Mechanic Mate logo are trademarks of Mfinity Infotech. You may not use them without our prior written consent.

You retain all rights to your Customer Data. By submitting Customer Data, you grant us a limited license to host, store, process and display that data solely as required to operate the App for you.

7. Third-Party Services

The App relies on third-party services including, without limitation:

• Google Firebase (Authentication, Firestore database, Cloud Storage)
• Razorpay (payment processing)
• WhatsApp / SMS gateways (notifications, where used)
• Apple Inc. and Google LLC (app distribution and in-app purchases)

Your use of these services is also governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. User Content

You are solely responsible for the content you upload to the App, including customer details, vehicle photos, invoice data and any messages sent through the App. You represent and warrant that you have all rights and consents required to upload such content.

We reserve the right (but have no obligation) to remove content that violates these Terms or applicable law.

9. Updates & Changes

We may update the App from time to time to add features, fix bugs and address security issues. Updates may be installed automatically. We may also modify these Terms at any time; material changes will be notified via the App or by email at least 7 days before they take effect. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

10. Termination

You may stop using the App at any time and delete your account from the in-app settings. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the App in a way that may cause legal liability or harm to us or other users.

Upon termination, your license to use the App ends immediately. Sections 5, 6, 11, 12 and 15 survive termination.

11. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that:

• The App will be uninterrupted, error-free or secure
• Defects will be corrected
• The App is free of viruses or other harmful components
• Any tax calculations, GST splits or invoice formats produced by the App are correct for your specific situation — you remain solely responsible for verifying compliance with applicable tax laws and should consult a qualified Chartered Accountant

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall Mohit Bhalodiya, Mfinity Infotech, or any of their personnel or licensors be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including lost profits, lost data, loss of goodwill or business interruption, arising out of or in connection with these Terms or your use of the App, even if advised of the possibility of such damages.

Our total cumulative liability arising out of these Terms or your use of the App shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) ₹1,000.

13. Apple App Store — Additional Terms

If you obtained the App from Apple's App Store, the following additional terms apply. In the event of any conflict between this Section 13 and any other part of these Terms, this Section 13 prevails for users on iOS.

13.1 Acknowledgment

You acknowledge that these Terms are concluded between you and Mohit Bhalodiya (operating as Mfinity Infotech) only, and not with Apple Inc. ("Apple"). Mohit Bhalodiya / Mfinity Infotech (and not Apple) is solely responsible for the App and its content.

13.2 Scope of License

The license granted to you in Section 1 is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in Apple's Media Services Terms and Conditions.

13.3 Maintenance & Support

Mohit Bhalodiya (Mfinity Infotech) is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services.

13.4 Warranty

Mohit Bhalodiya (Mfinity Infotech) is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.

13.5 Product Claims

Mohit Bhalodiya (Mfinity Infotech), not Apple, is responsible for addressing any claims by you or any third party relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.

13.6 Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Mohit Bhalodiya (Mfinity Infotech), not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.

13.7 Legal Compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

13.8 Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

14. Google Play Store — Additional Terms

If you obtained the App from the Google Play Store, your use is also subject to the Google Play Terms of Service. Google LLC is not a party to these Terms.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Subject to mandatory consumer protection laws of your place of residence, the courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
